Pets Not Allowed

Even Homeowners are Not Exempt

Contrary to the American Dream, or the old saying, "A man's home is his castle," home ownership does not always exempt us from discrimination. Homeowners' Associations may have CC&Rs limiting the number of allowable pets per household, or in fact, disallow any pets. The latter is more commonly found in condominium associations. It behooves a prospective purchaser of a home or condominium to request and carefully read all CC&Rs and other homeowner documents before making the commitment to buy. Otherwise you may later face a legal battle to keep your cats and dogs, which you may very well lose. Some legislators have a more open mind about the subject. In California, AB 860, if passed, would relax restrictions by both condominium CC&Rs ( called CID in this measure) and mobilehome park managers with regard to pets. ²As passed by the Assembly, this bill:
  1. Specified that no lease agreement entered into, modified, or renewed on or after July 1, 2000, shall prohibit a mobilehome owner from keeping a pet within the park subject to reasonable park rules and regulations set by the park management.
  2. Specified that for the purposes of this bill, "pet" is defined as any domesticated bird, cat, dog, aquatic animal kept within an aquarium, or any other animal agreed to between the management and the homeowner.
  3. Required new or amended CID governing documents to allow pets after July 1, 2000.

Unfortunately, a very similar bill was previously vetoed by Governor Wilson in 1998. Hopefully, this one will fare better.

No one should ever have to give up a pet because of a lack of housing that will accept it.
